IDENTIFICATION

La “Boutique Officielle La Vache qui rit®" is operated by LVQR Diffusion, a limited liability company with a share capital of €49,995.00, having its registered office located at 2 allée de Longchamp, 92150 Suresnes, France. The company is registered with the Nanterre Trade and Companies Register under number 483 742 607 and holds the intra-community VAT identification number FR 66 483 742 607.

PURPOSE OF LA BOUTIQUE OFFICIELLE LA VACHE QUI RIT®

The "Boutique Officielle La Vache qui rit®" offers for online sale a selection of merchandise featuring trademarks owned by BEL SA, including but not limited to La Vache qui rit®, Babybel®, Kiri®, Apéricube®, Pom'Potes®… (hereinafter referred to as the “Products”).

These Products are available for purchase on the website https://boutique.lavachequirit.com/ (hereinafter referred to as the “Website”).

Products are sold subject to availability. The " La Boutique Officielle La Vache qui rit®" is intended for individuals aged fifteen (15) years and older.

All correspondence may be sent either by email to info@boutique.lavachequirit.com or by postal mail to the following address: LVQR Diffusion – 2 allée de Longchamp – 92150 Suresnes – France.

ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

Any individual accessing the "Boutique Officielle La Vache qui rit®" (hereinafter referred to as the “Customer”) must, prior to viewing any information on the site and prior to placing any order for Products, read and accept these General Terms and Conditions of Sale (hereinafter referred to as the “GTCS”).

Accessing any page beyond this one, as well as confirming any Product order, constitutes acceptance by the Customer of the terms of these GTCS. By checking the box stating “By checking this box, you unreservedly accept our general terms and conditions of sale” during the checkout process, the Customer acknowledges their full and unconditional adherence to these GTCS and agrees to comply with their provisions.

These GTCS apply without restriction or reservation to all Products offered for sale by LVQR Diffusion.

LVQR Diffusion reserves the right to modify and update these GTCS at any time and without prior notice. However, the GTCS applicable to any Product order shall be those in force at the time the order is confirmed. Customers are therefore advised to regularly consult the latest version of the GTCS.


ORDERING PROCESS

The Customer may access the Product ordering features via the "Boutique Officielle La Vache qui rit®" website. If the Customer has created a profile, they may log in using the username and password generated during account creation.

The Customer may select Products by clicking the “Add to cart” button.

At any time prior to final order confirmation, the Customer may view the contents of their cart by clicking “My cart” and may remove any or all Products by clicking “Remove”.

Once the Product selection is complete, the Customer is prompted to enter a delivery address. If logged in, the Customer may confirm or modify the delivery and billing addresses.

The Customer is then invited to confirm the order following the steps outlined below.

Once the order is confirmed, the Customer proceeds to payment using the available methods. An electronic order confirmation will be sent.

LVQR Diffusion specifies that the contract is concluded in the French language.


ORDER CONFIRMATION

Prior to final confirmation of the order, which constitutes acceptance by the Customer, LVQR Diffusion summarizes the order details and the total price including all applicable taxes and invites the Customer to correct any errors by clicking “Return to cart”.

By clicking “Confirm payment”, the Customer definitively accepts the order and the entirety of these GTCS, fully and without reservation.

The distance sales contract is deemed concluded once the Customer confirms the order and completes payment. After this step, the Customer may no longer cancel the order (except in the case of exercising the right of withdrawal under the conditions set forth in Article XI of the GTCS).

The data recorded by LVQR Diffusion constitutes proof of the transaction between the Customer and LVQR Diffusion, which the Customer expressly accepts. This data will be confirmed electronically to the Customer as described below.


ORDER ACKNOWLEDGEMENT

An electronic order acknowledgment will be sent to the Customer without delay.

 

PRICES

Product prices are displayed in Euros (€), inclusive of all applicable taxes, but exclusive of delivery charges. Prices are subject to change, and LVQR Diffusion reserves the right to modify them at any time without prior notice. However, Products will be invoiced based on the prices in effect at the time the order is confirmed.

Access to the "Boutique Officielle La Vache qui rit®" is limited to the cost of connecting to the Internet.


PAYMENT

Payment for Products may be made by credit card (French national bank cards, Eurocard/Mastercard, international Visa cards, American Express) or via PayPal (Customers are invited to review the terms of use on PayPal’s website: https://www.paypal.com/fr/webapps/mpp/ua/legalhub-full ).

The "Boutique Officielle La Vache qui rit®" has entrusted the online payment platform STRIPE with the implementation of a secure Internet payment service by credit card. The security protocol used ensures the confidentiality of data exchanged between the Customer and the payment server. Credit card details are entered directly on the secure platform website, ensuring that neither LVQR Diffusion nor any technical intermediary has access to the card information. For further details, Customers are invited to consult STRIPE’s terms of use: https://stripe.com/fr/terms . The data recorded by the payment system constitutes proof of the financial transactions.


LOGIN AND PASSWORD

To ensure a smooth browsing experience, Customers may create an account identified by a login and password. These credentials are strictly personal and confidential.

The Customer agrees not to disclose them to any third party and is responsible for implementing appropriate security measures to protect their login and password.

Any access to the "Boutique Officielle La Vache qui rit®" functionalities using the login and password is deemed to be made by the Customer, who shall bear all resulting liability.


RIGHT OF WITHDRAWAL

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt of the Products to exercise their right of withdrawal without having to provide any reason or pay any penalties, except for return shipping costs, which remain the Customer’s responsibility.

If multiple Products were ordered in a single transaction, the fourteen (14) day period begins upon receipt of the last Product in the order.

To exercise this right:

  • The Customer must send LVQR Diffusion, within the aforementioned period, either electronically or by post, the withdrawal form attached as Annex I to these GTCS, to the address indicated above.

  • The Customer must also return the Products, at their own expense, in perfect condition and in their original packaging, no later than fourteen (14) business days following notification of their decision to withdraw.

Upon valid exercise of the right of withdrawal, LVQR Diffusion will reimburse the Customer using the same payment method used for the original transaction, for the purchase price of the returned Products, no later than fourteen (14) business days from receipt of the returned Products. Returned Products must be in perfect condition and in their original packaging to be eligible for reimbursement. Products must be in a resalable condition (i.e., in perfect condition, with original packaging, accessories, and instructions). Otherwise, LVQR Diffusion reserves the right to refuse reimbursement in whole or in part.


DELIVERY

Ordered Products are delivered:

  • Within mainland France and Corsica, to the delivery address provided by the Customer. Delivery costs of eight Euros (€8) per order are borne by the Customer, unless the total order amount reaches fifty Euros (€50) including VAT, except where otherwise stated (e.g., Julie Jaler and Dbj Home items). In such cases, delivery is free of charge.

  • Within the European Union, to the delivery address provided by the Customer. Delivery costs of thirty Euros (€30) including VAT per order are borne by the Customer, regardless of the order amount. Additional charges apply for Julie Jaler and Dbj Home items.

  • In Europe, outside the European Union, to the delivery address provided by the Customer. Delivery costs of fifty Euros (€50) per order are borne by the Customer, regardless of the order amount, excluding eventual customs fees. Additional charges apply for Julie Jaler and Dbj Home items.

  • In all other countries, to the delivery address provided by the Customer. Delivery costs of seventy-five Euros (€75) per order are borne by the Customer, regardless of the order amount.

Products are delivered subject to availability. LVQR Diffusion will prepare, ship, and deliver the order within a maximum of forty-five (45) days from the day following the order submission, unless otherwise stated (e.g., Julie Jaler and Dbj Home items).

In the event of a delivery delay, the Customer will be informed and may request a refund of the purchase price from LVQR Diffusion. Otherwise, the Products will be delivered as soon as they become available.

Upon receipt of the Products, the Customer is responsible for verifying that the transport contract has been properly executed. In particular, in the event of any anomalies upon delivery (e.g., damaged or opened packages), the Customer must take all necessary steps to enable LVQR Diffusion to pursue a claim against the carrier. Specifically, the Customer agrees to make detailed and substantiated reservations on the transport document provided by the carrier. If the carrier disputes these reservations, the Customer must notify them by registered letter with acknowledgment of receipt within three (3) business days following delivery, in accordance with Article L.133-3 of the French Commercial Code.

In all cases, the Customer agrees to send LVQR Diffusion, within forty-eight (48) hours of delivery, by registered letter with acknowledgment of receipt, a detailed report of the anomalies and/or damage, including photographs and a copy of the signed transport document, annotated if applicable. Failing this, the Customer shall bear all consequences of the anomalies and/or damage, without recourse against LVQR Diffusion and/or its insurer, and the delivery shall be deemed to conform to the order.

XI – WARRANTIES

LVQR Diffusion is bound by the statutory warranty of conformity for Products as provided under Articles L.217-4 et seq. of the French Consumer Code, as well as the warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, and more generally, any statutory warranty owed to consumers.

The legal warranty of conformity covers defects in the Product and/or its packaging.

The French Consumer Code provides the following provisions:

Article L.217-4

“The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when such installation is the seller’s responsibility under the contract or was carried out under the seller’s responsibility.”

Article L.217-5

The goods are deemed to conform to the contract if:

  1. They are fit for the purpose usually expected of similar goods and, where applicable:

  • correspond to the description given by the seller and possess the qualities presented to the buyer in the form of a sample or model;

  • present the qualities that a buyer may legitimately expect in light of public statements made by the seller, producer, or representative, particularly in advertising or labeling;

Or if they present the characteristics defined by mutual agreement between the parties or are fit for any special purpose sought by the buyer, brought to the seller’s attention and accepted by the seller.

Article L.217-9

“In the event of a lack of conformity, the buyer may choose between repair or replacement of the goods.
However, the seller may refuse the buyer’s choice if it entails a manifestly disproportionate cost compared to the alternative, considering the value of the goods or the significance of the defect. In such cases, the seller must proceed with the alternative method, unless it is impossible.”

Note: A minor defect for which repair or replacement is impossible or excessively costly does not entitle the buyer to terminate the contract.

Article L.217-7

The Customer:

  • has a period of two (2) years from delivery of the goods to take action;

  • may choose between repair or replacement, subject to the cost conditions set out in Article L.217-9;

  • is not required to prove the existence of the lack of conformity for six months following delivery. This period has been extended to twenty-four (24) months since March 18, 2016, except for second-hand goods.

Article L.217-12

“Any action resulting from a lack of conformity is time-barred after two years from the delivery of the goods.”

If a commercial warranty is granted by the seller, Article L.217-16 provides:

“When the buyer requests a repair covered by the commercial warranty granted at the time of purchase or repair of a movable good, any immobilization period of at least seven (7) days shall be added to the remaining warranty period.
This period begins from the buyer’s request for intervention or the provision of the item for repair, whichever is later.”


WARRANTY AGAINST HIDDEN DEFECTS

The warranty against hidden defects covers latent defects in the purchased Product that render it unusable or significantly impair its use to the extent that the Customer would not have purchased it, or would have paid a lower price, had they known.

The French Civil Code provides:

Article 1641

“The seller is liable for hidden defects in the item sold that render it unfit for its intended use, or that diminish its usefulness to such an extent that the buyer would not have purchased it, or would have paid a lower price, had they known.”

Article 1644

“In the cases provided for in Articles 1641 and 1643, the buyer may choose to return the item and receive a refund, or retain the item and receive a partial refund.”

Article 1645

“If the seller knew of the defects, they are liable not only for refunding the price received but also for all damages suffered by the buyer.”

Article 1646

“If the seller was unaware of the defects, they are only liable for refunding the price and reimbursing the buyer for costs incurred in the sale.”

Article 1648

“Any action resulting from redhibitory defects must be brought by the buyer within two years of discovering the defect. In the case provided for in Article 1642-1, the action must be brought within one year from the date the seller can be released from apparent defects or non-conformities.”


EXERCISING A WARRANTY

To exercise any statutory warranty, the Customer must:

  • Notify LVQR Diffusion by registered mail with acknowledgment of receipt at the following address:

  • Provide supporting documentation: delivery slip, invoice, receipt, etc.


CUSTOMER SERVICE – MEDIATION SERVICE

For further information, the LVQR Diffusion Customer Service team can be contacted via email at: info@boutique.lavachequirit.com

In the event of a complaint not resolved by Customer Service within two months, the Customer may, in accordance with Article L.612-1 of the French Consumer Code, “resort free of charge to a consumer mediator to seek amicable resolution of the dispute with a professional.”

The Customer may contact the Association des Médiateurs Européens (AME Conso):

  • Via the AME Conso website: https://www.mediationconso-ame.com , by completing the dedicated form and attaching supporting documents;

  • Or by postal mail to: AME Conso – 11 place Dauphine – 75001 Paris – France, with supporting documents.

Requests for mediation will not be admissible if:

  • The Customer has not first attempted to resolve the dispute directly with LVQR Diffusion’s Customer Service through a written complaint;

  • The request is manifestly unfounded or abusive;

  • The dispute has already been examined or is currently being examined by another mediator or a court;

  • The Customer submitted the request more than one year after the written complaint to LVQR Diffusion;

  • The dispute falls outside the scope of AME Conso’s competence.

LIABILITY

The Customer acknowledges that, despite all technical measures implemented by LVQR Diffusion and its partners, the Internet network has specific technical characteristics that prevent LVQR Diffusion from guaranteeing uninterrupted access to the "Boutique Officielle La Vache qui rit®" website.

The Customer also acknowledges that data transmissions over the Internet are technically unreliable, and that data is not protected against potential misuse, except within the scope of secure payment. It is therefore the Customer’s responsibility to take all appropriate measures to protect their data and equipment from viruses and unauthorized access attempts by third parties. The Customer acknowledges that their equipment is connected to the Internet under their sole responsibility, and LVQR Diffusion shall not be held liable for any damage that may occur during such connection.

Information available on the Website is provided “as is,” without any express or implied warranty, particularly regarding its accuracy or timeliness.

LVQR Diffusion’s liability is limited to direct damages suffered by the Customer in the event of partial or total non-performance of the Contract. The Customer must provide evidence of the damage incurred. Any compensation shall be limited to the amount paid by the Customer for the order.


PERSONAL DATA

The Customer is informed that their personal data is processed by LVQR Diffusion, acting as data controller, for the purpose of processing and managing their order. The Customer has the right to access, rectify, and, where applicable, the right to data portability and erasure, as well as the right to object to or restrict processing for legitimate reasons. These rights may be exercised at any time by contacting the Data Privacy Manager (DPM) at: info@boutique.lavachequirit.com and dpm@groupe-bel.com

CUSTOMER REVIEW SERVICE

Users who have made purchases on the website https://boutique.lavachequirit.com/fr may leave reviews on the site and on the purchased items via the “Avis Vérifiés” platform.

Posting a comment or review implies prior acceptance and compliance with these terms of use.

Constructive Reviews

The purpose of reviews is to provide honest and constructive feedback on the Website and/or the purchased Product(s), to promote transparency for future buyers and share experiences in a respectful and constructive manner.

Reviews must not:

  • Be defamatory, abusive, obscene, offensive, violent, or incite violence

  • Refer to political matters

  • Be racist or xenophobic

  • Violate applicable laws or regulations, personal rights, or public decency

  • Refer to or mention other users’ reviews

  • Be used for personal or professional purposes, including advertising

  • Contain personal data

  • Be unrelated to the reviewed product

Moderation
Reviews may be subject to moderation. LVQR Diffusion reserves the right, without justification, to delete or not publish any review that does not comply with the above requirements. The publication or non-publication of a review shall not give rise to any liability on the part of LVQR Diffusion.

If any person believes that a review infringes their rights or causes harm, they must notify LVQR Diffusion at: info@boutique.lavachequirit.com , so that appropriate action may be taken.

Some of the Customer’s personal data may be transmitted to our processor Skeepers (Avis Vérifiés) for the purpose of collecting feedback on the Customer’s experience with their order, in accordance with Article 6(f) of the General Data Protection Regulation (GDPR) (legitimate interest). The personal data shared includes name, surname, email address, order number, and order date. Skeepers will anonymize the review(s) eighteen (18) months after publication.

Skeepers uses personal data solely within the scope of its “Avis Vérifiés” solution and for its operational needs. Skeepers strictly prohibits the disclosure of any personal or identifiable information that could compromise the Customer’s privacy.

The Customer may object at any time to the processing of their data by Skeepers by contacting: privacy@skeepers.io


REVIEW USAGE AUTHORIZATION

The Customer grants LVQR Diffusion a free license to use the reviews they submit for purposes related to the marketing and promotion of the reviewed product, including the following distribution channels:

  • Online, including all institutional, commercial, or community websites, blogs and/or pages operated by LVQR Diffusion, and those of its partners or affiliates, as well as search engines displaying reviews and comments;

  • Internal and institutional communications by LVQR Diffusion and journalistic information;

  • All printed media

The granted usage rights include:

  • Reproduction rights: the right to reproduce, distribute, and copy the review, in whole or in part, on any current or future medium (paper, digital, electronic, audio, optical), free of charge or for a fee;

  • Representation rights: the right to publicly display the review, in whole or in part, by any means (e.g., screen display), in public or private venues;

  • Broadcasting rights: the right to broadcast the review via terrestrial, satellite, cable, or any other current or future telecommunications method, including internal networks and public networks such as Télétel and the Internet;

  • Derivative rights: the right to use, adapt, arrange, modify, translate the review, in whole or in part, free of charge or for a fee.

FORCE MAJEURE

LVQR Diffusion may be released from all or part of its liability by demonstrating that the non-performance or improper performance of the contract is attributable either to the Customer or to a case of force majeure as defined by French courts.


APPLICABLE LAW – JURISDICTION

Use of the "Boutique Officielle La Vache qui rit®" is governed by French law.

Any disputes relating to such use shall fall under the exclusive jurisdiction of the French courts.
